Be Ambiguous At Your Own Risk – Article by Mark Morfopoulos Published

Published: December 6, 2009

The title of Mark Morfopoulos’s newest article, just published in the Summer 2009 edition of the Shopping Center Legal Update, warns: “Be Ambiguous at Your Own Risk: Sloppy Draftsmanship Strikes Again!” In his article, the text of which can be found at: http://www.meislik.com/articles, Mark uses the 2008 Pennsylvania Superior Court decision in Giant Food Stores, LLC v. THF Silver Spring Development, L.P. to illustrate how litigation could have been avoided had the parties clearly written what they had actually agreed-upon. No one should ignore the warnings he gives.

Mark is an attorney in the Commercial Real Estate Group at Meislik & Meislik and has a special focus in the area of Retail Real Estate Law. He is a frequent contributor to legal and trade publications serving the commercial real estate market and has written on a wide range of topics from parking garage leases to SNDAs to professionalism. Mr. Morfopoulos formerly was an in-house attorney for a Fortune 500 company and, as such, regularly handled complex deals at domestic and international locations. While acting as in-house counsel he was instrumental in initiating a company-wide environmental audit program. As a private practitioner, Mark managed the Toys ‘R Us lease in Times Square, New York and negotiated a successful cable franchise contract with Verizon. Ira Meislik Appointed Vice-Chair ABA-RPTE Diversity Committee

Published: December 2, 2009

Ira Meislik, managing principal of the Montclair, New Jersey law firm of Meislik & Meislik, has been appointed as Vice Chair of the American Bar Association’s Real Property, Trust & Estate Law’s Diversity Committee after serving several years as a member of that Committee.

One of the major challenges of the new century is to build a legal profession that can effectively serve as the connecting link between citizens and the law. Data indicates that while our society is rapidly becoming more diverse, with minorities likely to reach majority status in 35-50 years, the legal profession remains more than 90 percent Caucasian. As clients become more heterogeneous, leaders of the profession must change to stay in tune with them. When asked about his appointment as Vice Chair, Ira Meislik replied, “I am thrilled to be part of the vital mission to explosively expand inclusivity in the Bar and in the public at large. This is an important goal and achieving it will aid in delivering the promise of America to all of its residents.”

Ira Meislik has been frequently recognized for his professional achievements. In 2009 alone, he was named as part of a select group of 176 attorneys — The BTI Client Service All-Star Team — for delivering the absolute best client service to Fortune 1000 clients. Also in 2009, Ira Meislik was named by Real Estate New Jersey magazine as one of the Garden State’s top real estate attorneys. He also was selected for inclusion within the New Jersey Super Lawyers listing published inside the April 2009 issue of New Jersey Monthly magazine. Ira Meislik has been included in the Real Estate category each year since the Super Lawyer’s designation first appeared in New Jersey. In addition, he has been selected for inclusion in The Best Lawyers In America®. In the United States, Best Lawyers compiles lists of outstanding attorneys by conducting exhaustive peer-review surveys in which thousands of leading lawyers confidentially evaluate their professional peers.

His practice is concentrated in two areas – Business Law and Commercial Real Estate Law. His business law practice covers general business, commercial, and transactional matters. In this area, he provides business counseling advice and handles business formations, acquisitions, mergers, and contracts. His commercial real estate practice focuses on the needs of landlords and tenants primarily within shopping centers and office properties. In addition, he has extensive experience in the acquisition, disposition, and financing of real property.
