In the Matter of the Application of: Rickron, Inc.

A-4236-00T5 (N.J. Super. App. Div. 2002) (Unpublished)

LIQUOR LICENSES— Municipalities are not obligated to remind liquor license holders about renewal deadlines.

The holder of a plenary retail alcohol distribution license failed to file its renewal on time. It then argued that loss of its license “would result in severe hardship.” It explained that the municipality failed, “for the first time in several years, to issue a license renewal reminder, and [its own director] was personally depressed and emotionally distraught by the death of his father… .” The Appellate Division showed no sympathy, holding that “[t]here is no statutory obligation for a municipal issuing authority to remind licensees of the need for annual renewal.” Further, “no matter what personal difficulties may have confronted the licensee, the Director is without authority to grant relief… .”
